POELLATH advises foundation on merger with another foundation

POELLATH has advised a foundation with legal personality in regard to the procedure introduced on 1 July 2023 for the merger of foundations (Sections 86 seq. German Civil Code).

The foundation plans to merge with another foundation with legal personality that is based in another federal state.

A focal point of the legal advice was the question of whether licenses under public law are transferred as part of such merger.
