Update Solvency II review - Qualification of fund investments as long-term equity positions?

In the trilogue negotiations on the revision of the Solvency II supervisory regime, the Council of the EU, the European Parliament and the European Commission reached an agreement in December 2023. The compromise text to amend the Solvency II Directive has now essentially been approved by the European Parliament and provides for modifications to the regulations for long-term equity investments (LTE), among other things. The article by Jens Steinmüller and Marco Bertl deals with the future adjustments in the area of LTE and the question of the extent to which it is already foreseeable that the planned changes will adequately implement points of criticism that have been raised to date regarding the usability of the LTE regulations to increase the attractiveness of this asset class and legal certainty.
