No compensation according to Art. 82 (1) DSGVO in case of breach of the duty to provide information according to Art. 15 GDPR
In recent years, the labor courts have reflexively ruled out claims for damages if companies did not fulfill the right to information pursuant to Art. 15 of the GDPR in a timely manner or in full. In a recent decision, the Nuremberg Regional Labor Court (LAG) clarifies that a breach of the duty to provide information does not lead to a claim for damages under Article 82 (1) of the GDPR. The prerequisite for a claim for damages under Art. 82 DSGVO is unlawful data processing and not merely the violation of a norm from the GDPR.
